These Terms of Use (“Terms”) govern your use of projectmagnet.com and any website, landing page or interactive tool operated by Project Magnet FZ-LLC (“Project Magnet”, “we”, “us”) (together, the “Sites”). By using the Sites you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Sites.
1. What the Sites do
The Sites provide information, estimates and interactive tools relating to home-improvement services, and connect homeowners who request it with independent home-improvement companies, contractors, dealers and lead-marketplace partners (“Service Partners”). Project Magnet is a marketing and referral service. We do not perform, sell, install, warrant or guarantee any home-improvement product or service. Any contract for services is between you and the Service Partner.
2. Estimates are estimates
Price ranges, safety scores, recommendations and other outputs of our tools are automated, indicative and based only on the information you enter. They are not quotes, offers, professional advice or a guarantee of price or suitability. Final pricing is determined by the Service Partner after an assessment of your property.
3. Service Partners
Service Partners are independent businesses. We may receive a fee from a Service Partner when we refer your request to them. We do not endorse any Service Partner and are not responsible for their licensing, workmanship, pricing, conduct, warranties or compliance with law. You are responsible for checking a Service Partner’s licence, insurance and references before hiring them.
4. Your submissions and consent to be contacted
You agree to provide accurate information and to submit requests only for a property you own or are authorised to act for. By submitting a request you agree that Project Magnet and the Service Partners we match you with may contact you as described in our Privacy Policy, including by phone, text message and email, and including with automated technology where you have consented. Consent is not a condition of purchase.
5. Acceptable use
You may not use the Sites to submit false or third-party information without authority; to scrape, crawl, copy or reverse-engineer the Sites or our tools; to interfere with their operation; or for any unlawful purpose.
6. Intellectual property
The Sites, our tools, text, graphics, logos and software are owned by Project Magnet or its licensors and protected by copyright and trademark law. You may use the Sites for personal, non-commercial purposes only. Service Partner names and marks belong to their owners.
7. Disclaimers
THE SITES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY SERVICE PARTNER WILL CONTACT YOU, ACCEPT YOUR PROJECT OR PERFORM TO ANY STANDARD.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PROJECT MAGNET AND ITS OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR DEALINGS WITH A SERVICE PARTNER, ARISING OUT OF OR RELATING TO THE SITES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITES WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100). Some jurisdictions do not allow certain limitations; in those places our liability is limited to the extent permitted.
9. Indemnity
You agree to indemnify Project Magnet against claims arising from your breach of these Terms or your misuse of the Sites.
10. Third-party links
The Sites may link to third-party websites. We are not responsible for their content or practices.
11. Changes and termination
We may change these Terms or discontinue the Sites at any time. Continued use after changes means you accept them.
12. Governing law and disputes
These Terms are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates without regard to conflict-of-law rules. Any dispute will be resolved in the courts of Dubai, except that you may bring claims in your local small-claims court where permitted. Nothing in these Terms limits any non-waivable consumer rights you have under the law of your state or country.
